Terms and Conditions
1. Subscription & Setup
The plan begins upon purchase and is required to host your AI Agent. Configuration starts only after the Agent Setup Form is submitted with all required assets.
2. Add-Ons & Extra Agents
Features like SMS Packs require custom re-configuration and may require a one-time Activation & Integration Fee plus the cost of the add-on. You may add additional agents for a one-off setup fee, provided your workspace has sufficient resources (e.g., talk minutes).
3. Timelines & Support
Initial Build: We aim for testing readiness within one week of receiving assets. This is a professional estimate, not a guarantee.
Monthly Support: Includes 30 mins for desk plan, or 60 mins for pod plan, of configuration time per month for minor adjustments. This is "use it or lose it" and does not roll over. Excess time is quoted at standard rates.
Volume: Includes 250 mins for desk plan, or 1120 mins for pod plan of agent talk-time per month.
4. Fair Use & Continuity
To ensure your business stays operational, Incendo provides a "Fair Use" cushion. If you exceed limits, we may cover overage costs at our discretion to keep your Agent active. If limits are exceeded twice in 12 months, we will contact you to upgrade or fund overages separately.
5. Adjustments & Pricing
We reserve the right to adjust fees with 30 days' notice and may modify or discontinue features to maintain system security or compliance.
6. Cancellation & Termination
Process: Cancel via accounts@incendo.co.nz. Cancellations take effect at the end of your next billing cycle.
No Refunds: Setup, activation, and integration fees are strictly non-refundable.
Incendo’s Right: We reserve the right to terminate or refuse service to any client, at our sole discretion, for any reason. Upon termination, workspace data is deleted by default.
7. Liability & Privacy
AI Accuracy: AI utilizes generative technology; we do not guarantee 100% accuracy. You agree to hold Incendo New Zealand Limited harmless from damages arising from unintended AI responses.
Hosting: Data is processed on secure servers outside of NZ (including USA, EU, or India). Use of service constitutes consent to this transfer.
Data & IP: We do not use your data to train public models. You retain data rights; Incendo retains ownership of the technical logic and prompt architecture.
8. Acceptable Use
Illegal, harassing, or unethical use is prohibited. We reserve the right to suspend any workspace in violation without a refund.
